Lack of security? Well, maybe, but there were loads of "do not enter" and "DANGER" signs, so I'm guessing not.

but my point is that no one stopped him from climbing the fence. and apparently, im not sure if this is true, he jumped up to touch someones foot. it is indeed his fault but his family will somehow win the suit.

I just don't see how... even in accident suits many theme parks have non-responsibility clauses.

You have the right to request a jury by the 6th (and expanded upon in the 14th) constitutional amendment.

If no jury is given, then never underestimate the power of an incompetent judge.

there was a guy that got into a wreck because he put the cruise control on, "supposedly" thinking it would control the van he was in, and went to the back of the vehicle. he won the lawsuit against the company because he said that the manual for the vehicle did not say that cruise control does not control the vehicle.

so tell me this idiots family wont win.

Well, if you're going by what was printed, in this case, there certainly were signs printed instructing that entry was not advised, plus he had to climb over a barricade...
Not that I don't trust you, but do you have a source for that cruise control case?

This is the closest I could find to the lawsuit Shadow's talking about, although idk if it's the right story. It's on Snopes, so they treat it as an urban legend: http://www.snopes.com/autos/techno/cruise.asp

As for the Batman story, I think it's sad but the kids were kind of asking for it. I was also watching Headline News yesterday and heard he tried to touch someone's foot as it passed. I'm sorry to say but....the area's restricted for a reason. The kids should have been more careful or, smarter - and stayed out of the area altogether. slant.gif
